What rights do children of a previous marraige have concerning property obtained in Cyprus. The children do not reside in Cyprus and the deceased did not leave a will.

Hi

The first question is whether the deceased was born in Britain or in another commonwealth country? Although you say the deceased did not leave a Will - perhaps they left a Will in another country - which could be resealed??

If there really is no Will - then the Cypriot rules of forced heirship will apply. These rules are complicated and who inherits depends on who survives the deceased. However, the most common position is that there is a surviving spouse and there are children. In this case the surviving spouse will take a proportion and then the children of the deceased will take the rest in equal shares.

The children retain their status - regardless of the marital status of the parents.

Kind regards
carol
